TERMS OF SERVICE - OFMAI.AI

Ofmai.ai (the "Platform") is a service provided by MANTRA AI TECHNOLOGIES ("we", "us", "our"). By accessing the Platform or using our artificial intelligence generation services, you agree to be bound without reservation by these Terms of Service (TOS). If you do not agree to these terms, you must immediately cease using the Platform.

Access to Ofmai.ai is strictly reserved for natural persons who are of legal age according to the laws of their country of residence, and in any event, are 18 years of age or older. MANDATORY DECLARATION: By using this service, you formally declare and under your sole responsibility: - To be of legal age according to the legislation of your country of residence - To be at least 18 years old - To be legally authorized to view and create sexual content SANCTIONS: Any use by a minor constitutes: - A violation of these terms resulting in immediate account deletion - A criminal offense likely to engage the liability of the minor's legal representatives - A ground for reporting to competent authorities IMPORTANT - LEGAL OBLIGATION: The user is informed that French legislation imposes on pornographic content platforms the implementation of age verification systems. To date, Ofmai.ai relies on the user's declaration. The user acknowledges that this declaration engages their personal liability and that any false declaration constitutes fraud.

3.1 Principle and guarantees The Platform allows the importation of files (images, videos) to train artificial intelligence models ("AI Double") and generate personalized content. MANDATORY USER GUARANTEES: By importing a file containing the image of one or more persons, the user FORMALLY guarantees and under their SOLE and ENTIRE responsibility: a) Either that they are strictly the person represented in the file b) Or that they have obtained the express, free, informed, specific, and WRITTEN consent of each identifiable person, expressly authorizing them to use their image to generate sexual content via artificial intelligence The user acknowledges that the absence of consent constitutes a serious criminal offense. 3.2 Strict Prohibitions It is FORMALLY FORBIDDEN to import or use the Platform to create content: - Depicting real persons without their express and written consent - Using the image of public figures, celebrities, influencers, politicians, or any known person - Imitating or impersonating a real person ("look-alike", "deepfake") - Involving or simulating minors, regardless of the technique used - Of a violent, hateful, discriminatory, or illegal nature - For the purpose of harassment, blackmail, revenge porn, or any other malicious purpose The user also refrains from distributing, sharing, commercializing, or making public such content. 3.3 Applicable Penal Sanctions The user is expressly informed that, in accordance with French law and comparable legislations: - The creation of a sexual montage depicting a person without their consent is punishable by 2 years imprisonment and a €60,000 fine (Article 226-8 of the Penal Code) - The distribution of such content is punishable by 3 years imprisonment and a €75,000 fine - These penalties are aggravated in certain circumstances (minor, vulnerable person, large-scale distribution) These sanctions are applicable regardless of the author's nationality or the platform's hosting location, provided that a victim is located in France or the content is accessible there. 3.4 Prevention and Detection Measures To prevent abusive uses, Ofmai.ai implements the following technical measures (reinforced warning, complete traceability, automated detection, digital marking, limitation). 3.5 Consequences of Violations Any violation of the above prohibitions results IMMEDIATELY and WITHOUT NOTICE in: suspension/permanent deletion of the account, deletion of content, blocking by fingerprint, retention of logs, reporting to authorities, and legal proceedings.

4.1 Role of Ofmai.ai Ofmai.ai provides a technical artificial intelligence solution allowing users to generate personalized visual content. Our role is strictly limited to: - Making available the technical infrastructure and algorithms - Providing temporary storage space for uploaded and generated files - Ensuring the technical functioning of the service Ofmai.ai exercises no prior editorial control over imported files, prompts, or generated content. 4.2 User's Exclusive Responsibility The user is SOLELY and ENTIRELY responsible for the lawfulness of the files they import, respect for third-party rights, obtaining consents, content generated via the Platform, and their usage. 4.3 Ofmai.ai Liability Regime In accordance with the regime applicable to hosting providers and technical service providers (LCEN, DSA), Ofmai.ai's liability can only be engaged on the condition that we have had actual knowledge of the manifestly illicit nature of specific content AND that we have not acted promptly to remove it. 4.4 Commercial Use Ofmai.ai authorizes the commercial use of content generated by the user, subject to compliance with the terms, third-party rights, and the user's entire responsibility.

5.1 Reporting Mechanism In accordance with the Digital Services Act (DSA), Ofmai.ai provides several reporting channels: - Dedicated online form: https://ofmai.ai/report - General email: [email protected] - Priority email for non-consensual intimate imagery (NCII): [email protected] - Emergency contact for victims: [email protected] Please provide a precise description, the reason, your contact details, and any useful evidence. 5.2 Processing of Reports Ofmai.ai commits to acknowledging receipt within 24 business hours and processing non-consensual intimate content with priority (within 12h max). 5.3 Trusted Flaggers Ofmai.ai cooperates with "trusted flaggers" designated by Arcom. 5.4 Cooperation with Authorities Ofmai.ai responds to requisitions from competent judicial and administrative authorities.

The User agrees to guarantee, indemnify, and hold harmless Ofmai.ai, its officers, and employees, against any complaint, legal action, loss, damage, or cost (including legal fees) arising from: - The User's violation of a third party's rights (right to image, privacy, intellectual property). - The absence of consent from a real model used for AI generations. - Any unlawful or fraudulent use of the Platform's services. This indemnification guarantee applies notably but not exclusively to the following cases: - Upload of files representing a person without their consent - Generation of sexual content impersonating others - Distribution or commercialization of content violating third-party rights - Use of the Platform for harassment, blackmail, revenge porn purposes - Any violation of the prohibitions stated in Article 3 The user acknowledges that Ofmai.ai has put in place clear warnings, prevention measures, and a reporting system, and that they have been fully informed of the risks and applicable sanctions. Consequently, the user cannot invoke any ignorance or misunderstanding of the applicable rules.

All rights to the technology, algorithms, and interface of the Platform remain the exclusive property of Ofmai.ai. The User retains rights to the generated media, provided they do not violate any third-party rights.

Due to the immediate provision of digital content and AI computing power, the User expressly agrees that the performance of the service begins immediately upon payment. Consequently, in accordance with consumer protection laws (Article L221-28 of the Consumer Code or equivalents), no right of withdrawal or refund applies once the service has been accessed or credits have been consumed.

The service is provided "as is". Ofmai.ai does not guarantee that the service will be uninterrupted or error-free. We shall not be held liable for indirect damages, loss of revenue, or damage to reputation resulting from the use of the Platform.

These terms are governed by French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of the registered office of the company publishing Ofmai.ai.

Personal data collected and processed by Ofmai.ai is done so in accordance with the General Data Protection Regulation (GDPR) and applicable legislation. COLLECTED DATA: - Account data: email, pseudonym, payment information - Technical data: IP address, device fingerprint, connection logs - Usage data: uploaded files, prompts, generated content, action history PURPOSES OF PROCESSING: Contract execution, abuse prevention, legal obligation compliance, service improvement. RETENTION DURATION: - Account data: subscription duration + 12 months - Technical and usage logs: 12 months minimum (legal obligation) - Reported content: until dispute resolution + 12 months USER RIGHTS: Right of access, rectification, erasure, limitation, opposition, portability. TRANSFERS OUTSIDE EU: Data may be processed or stored outside the EU in compliance with appropriate guarantees.
